What is Copyright?

Copyright is awarded to original literary, artistic, dramatic and musical works. Copyright is also awarded to sound recordings as well as to cinematography films.

Copyright ensures safeguards of the rights of the authors, artists, designers etc. Copyright gives exclusive right to the owner of the copyright to reproduce the work in public, to perform the work in public, to make adaptation of the work in different forms, to translate the work etc.

A copyright owner can take legal action against any person who infringes rights of the owner of the copyright. If a person without valid consent of the owner does or authorizes any act such as reproduces the work of owner is said to be guilty of infringement of copyright in the work. The owner can seek civil remedies such as injunctions, damages, accounts of profit etc. against such person.

The Copyright Act, 1957 also provides for penal provisions for offenses of infringement of copyright. Criminal action can be initiated against the accused for infringing copyright work. The Act provides that whoever is found guilty of offense of infringement under this act shall be punished with an imprisonment for a term which shall not be less 6 months but which may extend to 3 years and with fine which shall not be less than Rs.50,000/- but which may extend to Rs. 2,00,000/-.
